Types of Probation Violations
In Georgia, there are three primary probation violation categories:
- Technical: Failure to meet any technical conditions of probation, like reporting to the probation officer
- Special Condition: Failure to comply with any special conditions of probation, like obtaining employment or failing a drug test
- Substantive: The probationer allegedly commits a new crime
When a person is released on probation or parole, he or she must comply with certain guidelines in order to avoid arrest and revocation of probation or parole, which could result in the person having to serve the full term of his or her original sentence.
If you are accused of any type of violation of probation, you could face imprisonment, extended probation, fines, additional community service, or other penalties. Our Atlanta probation violation attorneys are here to help you avoid these serious consequences.
Can You Violate Probation and Not Go to Jail?
As mentioned above, you could face imprisonment for violating your probation, but in some cases, it is possible to violate probation and not go to jail in Georgia. For example, a judge may determine whether to extend or revoke probation instead of sending the offender to prison. In some cases, the judge may also require mandatory counseling or add additional restrictions such as drug testing or travel restrictions.
