How Georgia Classifies Murder Charges

Georgia Code § 16-5-1 defines forms of murder according to the circumstances surrounding the death and the prosecution’s theory of the offense.

Malice Murder & Felony Murder
Malice murder involves unlawfully causing another person’s death with express or implied malice aforethought. Express malice refers to a deliberate intention to take a life, while implied malice is determined from the circumstances surrounding the killing. Felony murder involves causing a death during the commission of a felony, irrespective of malice. Georgia law provides that murder is punishable by death, life imprisonment without parole, or life imprisonment.

Second-Degree Murder
This offense applies when a death results during the commission of second-degree cruelty to children. The potential sentence is imprisonment for 10 to 30 years. Because the classification is tied to a specific underlying offense, the alleged conduct and its relationship to the death require close examination.

Voluntary & Involuntary Manslaughter
Voluntary manslaughter under O.C.G.A. § 16-5-2 involves a killing committed under sudden, violent passion caused by serious provocation and carries a sentence of up to 20 years. O.C.G.A. § 16-5-3 defines involuntary manslaughter as causing a death without an intent to kill, either through a non-felony unlawful act or through a lawful act performed unlawfully in a manner likely to cause death or great bodily harm.

That right is limited in a capital felony case when the state seeks the death penalty. A guilty plea entered knowingly and voluntarily in that situation can’t be withdrawn as a matter of right.
