Georgia defines murder under O.C.G.A. § 16-5-1, and the distinction between charge types matters significantly for sentencing. Unlike many states, Georgia doesn’t use first-degree and second-degree murder as general categories. Instead, the law draws a line between two primary forms.

Malice Murder & Felony Murder
Malice murder is an intentional killing carried out with malice aforethought, which can be express (a deliberate intent to kill) or implied (conduct showing a reckless disregard for human life). Felony murder applies when a death occurs during the commission of an underlying felony, regardless of whether the defendant intended to cause death. Both carry the same sentencing range: life with the possibility of parole (with a minimum of 30 years before parole eligibility), life without parole, or the death penalty.
